Welcome to BulkMode! These Terms of Service ("Terms") govern Your use of the Service. By using the Service, You agree to these Terms.

1. Definitions

"Account" means the unique profile created for You to access the Service.

"Application" means the mobile application titled "BulkMode," including all related features, tools, content, and updates.

"Company," "We," "Us," or "Our" means Simplify Possible LLC, an Illinois limited liability company, with a mailing address at 4235 N Mobile Ave, Chicago, IL 60634, United States.

"Device" means any device capable of accessing the Service.

"Health Data" means information You provide relating to Your physical characteristics, health, nutrition, or goals, including weight, height, age, gender, food logs, calorie targets, and progress metrics.

"Service" means, collectively, the Application, the Website, associated software, content, AI-powered tools, and any services offered by the Company. The Service is designed exclusively to help users gain weight in a healthy manner; it is not intended for weight loss, calorie restriction, or maintaining a caloric deficit.

"User Content" means any images, photographs, text, or other content uploaded, submitted, or transmitted by You through the Service.

"Website" means bulkmode.app and any associated subdomains.

"You" means the individual using the Service or the legal entity on whose behalf the individual uses the Service.

2. Account and Registration

Eligibility

The Service is not intended for children under 13 years of age. By using the Service, You confirm that You are at least 13 years old.

Users ages 13-17: We strongly recommend parental supervision when using the Service. Consult with Your parents or healthcare professionals before tracking nutrition.

Children's Privacy

We do not knowingly collect Personal Information from children under 13. If We learn that a child under 13 has provided Us with Personal Information, We will delete it promptly. If You believe a child under 13 has submitted information to Us, please contact support@bulkmode.app.

Account Responsibility

You are responsible for:

Account Termination

You may delete Your Account at any time through the Application settings. We may suspend or terminate Your Account if You violate these Terms.

Data Export

You may export Your data (including food logs, weight history, and other Health Data) in a machine-readable format (compressed JSON) at any time through the Application settings. We recommend exporting Your data before deleting Your Account, as deletion is permanent and cannot be reversed.

3. Use of the Service

License

We grant You a limited, non-exclusive, non-transferable, revocable license to use the Service for Your personal, non-commercial use.

General Referral Terms

Intended Use

BulkMode is for weight gain only. The Service is designed exclusively for users who want to gain weight healthily. It is NOT intended for weight loss, calorie restriction, or maintaining a caloric deficit. If Your goal is to lose weight, this Service is not appropriate for You.

Health Disclaimer

The Service is NOT medical advice. The Application is a weight gain tracking tool that provides AI-powered nutritional estimates. It is NOT a substitute for professional medical advice, diagnosis, or treatment. Always consult Your doctor, registered dietitian, or healthcare provider before starting any weight gain program—especially if You are underweight, recovering from illness, or have any medical conditions.

The calorie and macronutrient estimates provided by Our AI are approximations only and may not be 100% accurate. You are solely responsible for verifying nutritional information and making Your own health decisions. Healthy weight gain should be gradual— consult a professional about what's right for Your body.

Calorie and macro targets provided by the Service are calculated using algorithms based on general nutrition science principles and Your profile data. Individual metabolic rates vary significantly, and these targets are starting points that You should adjust based on Your actual results and how You feel. The Service's adaptive learning feature attempts to improve accuracy over time but cannot account for all individual factors.

Eating Disorders and Mental Health

If You have or are at risk for an eating disorder, the Service is not suitable for You. This includes disorders related to both undereating AND overeating. Please seek professional help immediately. The Service should never replace proper medical treatment or therapy.

Binge Eating Disorder: If You struggle with compulsive overeating, eating past the point of fullness, or feeling out of control around food, please consult a healthcare professional before using a calorie tracking app.

Muscle Dysmorphia ("Bigorexia"): If You experience obsessive thoughts about being too small or not muscular enough, compulsive exercise, or anxiety about missing meals that interferes with daily life, please seek support. The goal of healthy weight gain is improved wellbeing, not perfection.

Warning signs to stop using the Service and seek help:

Resources: The National Eating Disorders Association (NEDA) provides support for ALL eating disorders, including binge eating and muscle dysmorphia. Call 1-800-931-2237 or text "NEDA" to 741741. In crisis, call 988 or go to Your nearest emergency room.

Minors and Young Adults

If You are under 18, You must have parental or guardian supervision when using the Service. Growing bodies have unique nutritional needs, and weight gain goals should be discussed with a pediatrician or healthcare provider. Teen athletes and those going through puberty especially benefit from professional guidance on healthy eating.

4. Subscriptions and Payments

Subscription Plans

The Service offers subscription plans with different features and pricing. Subscription fees are charged through the Apple App Store.

Billing

Free Trials

The Service offers a 3-day free trial for annual subscriptions. Users who sign up through Our referral program may receive an extended 1-month free trial for annual subscriptions.

Free trials automatically convert to paid subscriptions unless cancelled at least 24 hours before the trial period ends. You can cancel anytime through Your Apple App Store subscription settings.

Refunds

All payments are processed through Apple. Refund requests must be made through Apple according to their refund policy. We do not process refunds directly.

Cancellation

You may cancel Your subscription at any time through Your Apple ID settings. Cancellation takes effect at the end of Your current billing period—You will retain access to premium features until then, but no refund will be issued for the remaining time. We do not offer prorated refunds for partial billing periods.

Price Changes

We may change subscription prices at any time. Price changes will apply to new subscribers and to existing subscribers upon renewal (you'll be notified in advance).

European Union Consumers

If You are located in the European Union, You have a statutory 14-day withdrawal right for digital subscriptions under EU consumer protection law. By beginning to use the Service immediately after purchase, You acknowledge that:

If You do not begin using the Service and wish to withdraw within 14 days, You may request a refund through Apple according to their refund process. Nothing in these Terms limits Your statutory consumer rights under applicable EU law.

5. Intellectual Property

Our Content

The Service and all its content (design, code, graphics, interface, text) are owned by the Company and protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain full ownership of all User Content You create in the Service, including food log entries, photos, notes, and any other content You upload or enter. We do not claim any ownership rights over Your content. By using the Service, You grant Us a limited, non-exclusive, worldwide, royalty-free, transferable, sublicensable license solely to:

If We begin retaining photos for AI improvement, they would be de-identified and could not be linked back to You. We do not claim ownership of Your Personal Data and will not use identifiable data for purposes beyond those described in Our Privacy Policy.

Upon Account deletion: When You delete Your Account, all of Your User Content is permanently deleted from Our servers (subject to the backup retention periods described in Our Privacy Policy). Any previously anonymized data that was de-identified for AI improvement purposes cannot be deleted as it is no longer linked to Your Account. You may export Your data before deletion using the export feature in the Application.

AI-Generated Content

Nutritional estimates generated by Our AI from Your food photos are provided "as is" without warranties. You are responsible for verifying the accuracy of AI-generated estimates. For details on how Your photos are processed and which third-party AI providers We use, see Our Privacy Policy.

We continuously work to improve accuracy and may update Our analysis methods, AI models, data sources, and third-party providers at any time without notice. Such updates are part of Our ongoing Service improvements.

Feedback

If You provide Us with feedback, suggestions, ideas, or feature requests ("Feedback"), You grant Us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that Feedback into the Service without any obligation to compensate You. Do not share Feedback if You expect payment or confidential treatment.

6. Disclaimers and Limitations

Service Availability

We strive to provide reliable access to the Service, but We do not guarantee uninterrupted availability. You acknowledge that:

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for:

Our total liability to You for all claims shall not exceed the amount You paid Us in the 12 months before the claim (or $100, whichever is greater).

Indemnification

You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from Your use of the Service or violation of these Terms.

Force Majeure

We are not liable for any failure or delay in performing Our obligations under these Terms due to circumstances beyond Our reasonable control, including but not limited to natural disasters, acts of war or terrorism, pandemics, internet or telecommunications outages, power failures, government actions, or third-party service provider failures.

7. Termination

We may suspend or terminate Your access to the Service at any time, without prior notice, for any reason, including if You:

8. Changes to Terms

We may update these Terms occasionally. When We do, We'll update the "Last updated" date at the top of this page. For significant changes, We may also notify You through the Application or by email where possible.

Your continued use of the Service after changes indicates Your acceptance of the updated Terms. If You don't agree, please stop using the Service and delete Your Account.

9. Governing Law and Disputes

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles.

Dispute Resolution

If You have a dispute with Us, please contact Us first at support@bulkmode.app to try to resolve it informally.

Arbitration

For disputes that cannot be resolved informally, You agree to binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Cook County, Illinois, unless You and We agree otherwise. You may instead choose to bring an individual action in small claims court.

Right to Opt Out of Arbitration

You may opt out of this arbitration agreement by sending written notice to support@bulkmode.app within 30 days of first using the Service. Your opt-out notice must include Your name and a clear statement that You decline the arbitration agreement. If You opt out, You may pursue claims in court, but all other Terms remain in effect. Opting out will not affect Your ability to use the Service.

Class Action Waiver

You agree to resolve disputes with Us on an individual basis and waive Your right to participate in class action lawsuits.

Severability of Arbitration Provisions

If any portion of the arbitration agreement or waiver provisions in this Section is found to be unenforceable, the unenforceable portion shall be severed, and the remainder of this Section shall remain in full force and effect. If a court determines that applicable law prohibits enforcement of any waiver (such as a waiver of public injunctive relief), then the claim for such relief must be litigated in court, and all remaining claims shall be resolved through arbitration.

10. Miscellaneous

Entire Agreement

These Terms, along with Our Privacy Policy, constitute the entire agreement between You and the Company regarding the Service.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect.

No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

We may assign these Terms to another company (e.g., in a merger or acquisition). You may not assign these Terms without Our written consent.

Third-Party Services

The Service uses third-party services (Apple App Store, AI providers, etc.) that have their own terms. We're not responsible for third-party services.

Apple App Store Terms

If You download the Application from the Apple App Store, You acknowledge and agree that:

Note: Calorie and macro target calculations use formula-based algorithms and statistical methods (not AI). These calculations are based on established nutrition science and Your profile data, and adapt over time based on Your actual progress.

AI Disclaimers

AI features are provided "as is" without warranties of accuracy, completeness, or fitness for any particular purpose. You are solely responsible for verifying AI-generated information and making Your own health and nutrition decisions.
